Terms of Service

1. What this covers

——— (“we”) provides Guesti, software for running a venue: point of sale, bookings, guest wristbands, stock, reports and a venue website. You use it as a business, for your venue. These terms apply from the moment you create an account. The service is provided as software. We do not sell food or drink, we do not accept money from your guests, and we are not a party to anything you agree with them.

2. Your account and your staff

You give accurate details when you register and keep them current. You decide who on your team gets access and with what role; everything done under your account — including by your staff with their PIN — counts as done by you. Keep passwords and PINs to the people they belong to. Tell us promptly if you believe someone has access who should not.

3. Price, trial and payment

The subscription is charged per venue, per month or per year, at the price shown when you subscribe. There is no percentage of your turnover. The trial period is free and needs no payment details. Invoices are issued in advance for the period. If an invoice stays unpaid past its due date, we may suspend access after notifying you; your data is kept and access returns when the invoice is paid. Fees already paid for a started period are not refunded, unless the law says otherwise or we agree otherwise in writing.

4. Your data

Everything you and your guests put into the service — menu, checks, bookings, guest records, reports — belongs to you. We process it to provide the service and on your instructions, as described in the Privacy Policy. You can export your data at any time from the reports and accounting screens. If the contract ends, you have 30 days to export; after that we may delete it, except what we must keep by law.

5. Availability

We keep the service running and back up the database, but we do not promise uninterrupted operation. Updates and maintenance are done outside peak hours where possible. The point of sale keeps working without a connection: orders and payments are stored on the terminal and sync when the connection returns. This is the protection we designed for an outage — not a promise that outages will not happen.

6. Responsibility

You are responsible for how you run your venue: prices, taxes, receipts, licences, labour, and the accuracy of what your staff enter. We are responsible for the software working as described. Our liability for any claim connected to the service is limited to the fees you paid for the three months before the claim. We are not liable for lost profit, lost guests, or damages that neither side could reasonably foresee. Nothing here removes liability that cannot be excluded by law.

7. Ending the contract

You may stop using the service at any time; the subscription then ends at the end of the paid period. We may end the contract with 30 days' notice, or immediately if the service is used for something illegal or in a way that harms other customers. Either way, you keep the export window described in section 4.

8. Law and disputes

These terms are governed by the law of Thailand. We try to settle any dispute by talking first — write to hello@guesti.app. If that fails, the dispute is decided by the competent courts of Thailand. Operator: ———, ———.
